We
appreciate that disputes are a part of modern commerce.
Disputes arise in a wide range of contexts. We have experience
in dealing with disputes arising from commercial agreements
of varying sizes. We also have experience in dealing with
more complex transactions including Corporations Act and
Trade Practices Act issues.
When
should you contact us?
We
consider that a pro-active approach is essential to deal
effectively with commercial disputes. By seeking advice
at the earliest possible opportunity you give yourself the
best chance of identifying issues in dispute and constructively
communicating with other parties to the dispute. We actively
promote alternative dispute resolution procedures and can
recommend a range of measures from informal conferences
through to court assisted mediation to help you resolve
your dispute.
What
if a matter has to go to court ?
The
nature of disputes is such that sometimes alternative dispute
resolution measures are inappropriate or ineffective. In
those circumstances we are able to cost effectively manage
both large and small scale litigation in all jurisdictions
within South Australia. We are acutely aware of the steps
required to properly prepare an action for trial and successfully
communicate the merits of the action to the relevant court.
How
long will it take?
It
is impossible to predict how long a dispute will take to
resolve. The nature, size and number of parties to a dispute
will have some influence as will the current workload of
the relevant court or tribunal. By keeping an open mind
to alternative dispute resolution procedures throughout
the course of the action and being experienced in the conduct
of complex litigation we are in a good position to assist
you to achieve an expedited result.
How
much will it cost?
It
is common knowledge that disputes can be expensive and unproductive.
On taking your initial instructions we will provide you
with a cost estimate of proceeding through to trial. We
will re-visit that cost estimate regularly through the course
of the dispute and use that revised estimate as a balance
against any risks that we identify. We will use that balance
to assist you in making a decision to accept or make a commercial
proposal to resolve the dispute.
