An
Australian Workplace Agreement (AWA) is an agreement between
a worker and his or her employer that has been approved
by the Employment Advocate.
An
AWA can be negotiated between employers and individual workers
or groups of workers (although an AWA that is jointly negotiated
still has to be signed individually). Prior to it coming
into effect the AWA has to be checked by the Employment
Advocate to be sure that it passes the 'no disadvantage'
test. (While the wages and conditions under the AWA may
be different from the wages and conditions under
an award, they can't be less advantageous, when considered
on a whole, to the worker.)
AWAs
are designed to bring more flexibility to a workplace. They
don't suit everyone but, properly used, they can bring about
positive workplace changes that advantage both the workers
and the employer.
